In a major ruling, the Supreme Court has confirmed that the Navi Mumbai Municipal Corporation (NMMC) has the legal authority to collect property tax from industries located in the Thane Trans Creek-MIDC (TTC-MIDC) area, popularly known as the Thane-Belapur industrial corridor.
The decision is significant because it clears a long-running dispute and allows NMMC to collect property tax from more than 3,000 industries operating in the region.
The issue dates back to 2001, when the Small Scale Entrepreneurs Association (SSEA) challenged NMMC's property tax demand. The association argued that the Maharashtra Industrial Development Corporation (MIDC) was already collecting service charges from industries in the area and questioned whether NMMC had the right to levy property tax as well.
The Bombay High Court had earlier ruled in favour of NMMC. The matter was later taken to the Supreme Court, which has now upheld that decision.
The apex court clarified that the entire TTC-MIDC area falls under NMMC's jurisdiction. It also explained that property tax and service charges are different. While a municipal corporation can levy taxes, MIDC is only authorised to collect fees or service charges for the facilities and services it provides.
The court further stated that claims of double taxation were not valid because taxes and service fees are separate payments collected for different purposes. As a result, NMMC's right to collect property tax in the industrial corridor has been confirmed.

The ruling opens the door for NMMC to recover more than โน800 crore in pending property tax dues from industrial units in the TTC-MIDC area. Civic officials believe the additional revenue can be used to improve infrastructure, public services, and development projects across Navi Mumbai.
For industries operating in the corridor, the judgment provides clarity on which authority is responsible for collecting property tax. However, industry representatives have indicated that they plan to file a review petition and continue their legal challenge.
With the Supreme Court's verdict, a dispute that has lasted for over two decades appears to have reached a decisive stage, strengthening NMMC's position in one of Maharashtra's largest industrial zones.
