The Imperial Residents In Tardeo Get Relief in Construction Dispute
Residents of The Imperial, the landmark twin-tower residential development in Tardeo, have received relief from the Supreme Court in an ongoing dispute over additional construction.
Nearly 50 homeowners from Towers A and B had challenged revised building plans and proposed construction within the larger development.
An earlier Bombay High Court order prevented additions or alterations to the two existing towers without flat purchasers’ consent and restricted construction of Tower C to 38,500 sq. metres.
The developer challenged those restrictions, and parts of the order were subsequently stayed while its appeal was pending.
The Supreme Court has now restored the earlier interim restrictions for the duration of that appeal and requested that the Bombay High Court hear the matter on priority.
For existing homeowners and resale buyers, the dispute highlights an important aspect of property due diligence.
A buyer evaluating a premium apartment should understand not only the individual flat but also the sanctioned and disclosed layout of the entire development.
Potential future towers or additional construction can affect factors such as views, privacy, open spaces, density and ultimately the desirability of an existing residence.
